Estão a ser preparados em Bruxelas novos regulamentos sobre as sementes. Se os planos da Direcção-Geral para a Saúde e os Consumidores se tornarem realidade, irão desaparecer do mercado muitas mais variedades raras e antigas de frutas, vegetais e cereais. Esta diversidade de sementes e de variedades adaptadas à agricultura biológica está prestes a ser enfraquecida pela burocracia, enquanto o poder das corporações agrícolas será ainda mais fortalecido.
Dos textos actualmente disponíveis sobre o novo regulamento da União Europeia para as sementes compreende-se que será promovida a concentração do mercado das sementes nas mãos de um pequeno número de corporações industriais produtoras de sementes. Isto é inaceitável. Um novo regulamento da UE deve permitir diversidade de variedades, variedades que possam ser utilizadas em agricultura de pequena escala e na agricultura ecológica, onde são naturalmente adaptadas e reproduzidas por meios naturais. Uma grande diversidade de variedades deve continuar a estar disponível, não apenas em bancos de sementes mas também no mercado livre, sem qualquer tipo de restrições burocráticas.
Pelos motivos enunciados exigimos que não haja obrigação de registo de sementes! Além disto, os actuais critérios de registo de sementes deverão ser simplificados para as variedades adequadas à agricultura biológica em virtude da sua diversidade, para que a nossa agricultura continue a ser adaptável às alterações climáticas, a novas pragas e doenças, bem como a estilos de vida mais amigos do ambiente.
Nem a Lei das Sementes actualmente em vigor na União Europeia, nem as emendas a essa lei informalmente apresentadas até agora, preenchem estes requisitos. Ambas ameaçam a diversidade das sementes e, como tal, o património agrícola comum da Humanidade. Ameaçam também a produção sustentável de alimentos, existindo apenas para servir a indústria agroquímica.
Instamo-vos, Comissão Europeia, Parlamento e Membros do Conselho, a que rejeitem qualquer proposta que não preencha os critérios acima mencionados! Basta de destruição da diversidade das sementes agrícolas e hortícolas na Europa!

As regulações europeias actuais sobre sementes provêm de uma época na qual a protecção ambiental, a Natureza e a biodiversidade eram subestimadas. Nessa altura, foram várias as empresas de melhoramento de sementes que colocaram um número considerável de sementes no mercado. A maior parte destas variedades podia ser re-semeada após a colheita: uma técnica milenar, praticada durante toda a história da agricultura.
Nos anos 80, dois novos termos foram desenvolvidos para aquilo que até aí era uma prática comum: primeiro, “direitos dos agricultores” e, depois, “variedades de polinização aberta” (cujas sementes produzem a mesma variedade, a menos que sejam cruzadas com variedades semelhantes). Tal deve-se ao facto do mercado das sementes ter mudado radicalmente. Hoje em dia, as dez maiores empresas dominam três quartos do mercado mundial de sementes e mais de metade do mercado global está ligado à indústria química.
A maioria das sementes encontra-se sujeita a restrições legais e técnicas, que minam as possibilidades de utilização das sementes guardadas pelos produtores agrícolas.
A comercialização de variedades foi aprovada oficialmente e os critérios de comercialização foram adaptados para as variedades industriais. O aumento da população mundial e da produtividade agrícola foram os argumentos utilizados para justificar estas mudanças. O relatório “International Assessment of Agricultural Knowledge, Science and Technology for Development” (IAASTD) elaborado pelo Banco Mundial / ONU ilustra, de modo aprofundado, a instabilidade desta abordagem.
Grande parte da diversidade das culturas desapareceu do mercado. E isto diz respeito à diversidade de variedades não-registadas que são trocadas por milhares de cidadãos, na Europa, sem o registo oficial exigido. Contamos, hoje, com a profunda experiência destas pessoas e devemos incentivar aqueles que vêm, cada vez maior número, envolvendo-se neste tipo de acção de recolha de sementes, e para quem isso não representa um passatempo, mas a base do seu modo de vida e também do seu rendimento.
Um outro aspecto igualmente importante é que quase nenhuma das variedades tem sido criada especificamente para a agricultura biológica, em virtude da sua diversidade. A agricultura biológica necessita de plantas que sejam resistentes, sem recurso a produtos químicos. Tal só é possível com um manancial genético amplo e natural. Estas variedades são, geralmente, consideradas inaceitáveis segundo os critérios de registo oficial de sementes.

voting 6 on the Commissions proposal: 15 yes; 615 no, 13 abstained;
voting 7 on the request for a referral: 574 yes, 90 no, 10 abstained;

We've made it! The Parliament of the EU has decided: the Commissions proposal for a seed regulation is politically dead. In yesterdays plenary session was adopted with 51 to 130 votes a legislative resolution, which rejects the proposal of 6 Mai 2013 very clear and calls the Commission to submit a new one.
Until the last moment it was unclear: would the Parliament adopt such a legally binding resolution or would it restrict itself to a simple appeal to the Commission to withdraw the proposal? This appeal in the so called rejection report got 650 to 15 votes. But the Parliament insisted in a voting on the legislative resolution with the above mentioned result.
By this the longstanding engagement of organisations and groups which are dedicated to the maintaining and broadening of diversity, which are working for farmers rights to produce, exchange and use their seed or which are breeding varieties for ecofarming was successful.
With this decision the Parliament gave ear to the many hundreds of thousands of people from many European countries which signed since April 2013 diverse petitions against the Commissions proposal. Alone our petition „seed diversity under threat“ got some 150.000 supporters in 12 different languages.
A big „THANK YOU“ to all of you!
Now it would be important to adopt the current – even restrictive – EU-seed-law to the demands of maintaining and broadening of diversity. By this there should be given a reasonable legal framework to the groups, organisations and individuals which are engaged in this, and these initiatives should be supported and not restricted. A first step could be the evaluation of the so called conservation directives 2008/62/EC and 2009/145/EC, which should be done (as the directive itself demands) until end of 2013.
On the other hand the official control of the seeds of the seed industry has to be ensured. Concentration processes through acquisitions and interdependence have led in the past 30 years to a dangerous market power of the major chemical and seed corporations. And the seed industry won't give up their aim. Yesterday the seed lobby ESA tried to disturb the audience be claiming that the decision taken by the Parliament is invalid by procedural mistakes, see http://kurzlink.de/esa-seedlaw-140311. Anyhow, ESA's Secretary General Garlich von Essen had to admit the strength of the opponents to the new seed regulation and has spoken of a "very, very strong campaign".
Now we have to wait and be aware of how the Commission and the Council react on the resolution of the Parliament – and we will be attentive to intervene if necessary. In the times of climate change and exhaustion of resources we need a reorientation in the demands to varieties. How long agriculture and horticulture will be able to afford high-input-varieties? In the long run we need varieties with a positive energy balance – for this we need a rethinking in the seed legislation, and for this the support of you all will be needed furthermore!
