THIS IS A PETITION AGAINST:
TOLEDO PLAN COMMISSION CASE NO. Z-3004-24 (zoning change) and SUP-2004-24 (Special Use Permit)
REQUEST: Zone change from CN (Neighborhood Commercial) to CR (Regional Commercial) and Special Use Permit for a new Sheetz convenience store/gas station at 1405 Bernath Pkwy.

Sheetz has proposed to build a gas station and restaurant in the middle of our residential community at the intersection of Bernath Parkway and Airport Highway. The residents of Bernath Village and surrounding areas are vehemently opposed to this development for many reasons:

We ask you to join us by signing our petition and signaling your opposition to this unnecessary and unwanted gas station which will permanently, and negatively impact the quality of life in all of the surrounding neighborhoods!
The City of Toledo Planning Commission public hearing scheduled for May 9, 2024 to consider the requests for the zoning change and Special Use Permit was postponed at the developer's request. We do not know the rescheduled date yet. It will be posted here when available.

The citizens of Bernath Village oppose this development for the following reasons:
- 24/7 hours: The City of Toledo planning commission has not committed to explicitly limiting the hours of this establishment from 5:30 am to 1 am, as recommended in their own report, as a condition of the proposed Special Use Permit SUP-2004-24 and zoning change Z-3004-24 from Neighborhood Commercial to Regional Commercial.
- Noise and light: The proposed Sheetz gas station lies directly across Bernath Parkway from our community, Bernath Village. Some units are located less than 100 feet from this development without an adequate buffer to alleviate noise and light pollution at all hours of the night.
- Crime: Residents are concerned with the potential for increased criminal activity resulting from the 24-hour operation of this gas station and restaurant.
- Traffic: Ingress to the gas station from westbound Airport Highway, and egress to westbound Airport Highway will be routed on Bernath Parkway, resulting in a large increase of traffic which will make it difficult for residents to exit the driveway.
- Loss of existing small businesses: The existing small retail strip center and outbuildings located on the property would be demolished, resulting in the closure or displacement of the current tenants which include a home healthcare company (G&M Healthcare), a popular restaurant (Koreana), a convenience store, and several other retail shops and offices.
- Environment: Surface runoff from this property will flow through the storm sewer system into Swan Creek, potentially contaminating it with gasoline, oil, and other automotive chemicals.

I lived in a Bernath Village condo for 13 years. It is a very kid and dog friendly neighborhood. A gas station would bring nothing but lots of traffic, noise and potential crime. People in that neighborhood walk their dogs at all hours and a gas station open until 1am will most likely attract a not so great crowd then. My husband lived next to a gas station in his 20's and had to move due to constant noise, fighting, drunk people and general crime there. Bernath village does not need this too.
